Just as the GOP was beginning to solidify its support behind Donald Trump last week, some Capitol Hill Republicans are now distancing themselves from their presumptive presidential nominee. His attacks on the federal judge presiding over his Trump University lawsuit are being condemned as inappropriate, or even un-American.

Already, Sen. Mark Kirk (R – Illinois) has issued an un-endorsement of Trump, saying he cannot support the top of the ticket while others like Rep. Reid Ribble (R – Wisconsin) continue to stand firm as part of #NeverTrump.

“Something that walks like a duck, talks like a duck, is likely to be a duck,” Ribble said on Wednesday. “If you continue to say what I believe are racist statements, you’re likely to be a racist.”

Despite Trump issuing a statement that his comments were misconstrued, Washington Post conservative columnist Jennifer Rubin says it shouldn’t stop there.

“Why didn’t they do this sooner? Certainly they saw this coming. They knew exactly what they were getting with Donald Trump,” Rubin says. “I think they have been slow off the mark continually. They were slow off the mark recognizing he was going to be a force, they were slow off the mark once he was the presumptive nominee and trying to move into his campaign and try to shape him in some way that would be more acceptable, and I think they are slow off the mark now in figuring out how to distance themselves.”

But party leaders say they will vote for their nominee, focused as they are on defeating the presumptive Democratic nominee Hillary Clinton.

“Claiming a person can’t do their job because of their race is sort of like the textbook definition of a racist comment,” House Speaker Paul Ryan (R – Wisconsin) said. “But do I believe that Hillary Clinton is the answer? No, I do not. Do I believe that Hillary Clinton is going to be the answer to solving these problems? I do not. I believe that we have more common ground on the policy issues of the day, and we have more likelihood of getting our policies enacted with him than with we do with her.”

The judge, Gonzalo Curiel, is of Hispanic heritage, born in Indiana to parents who had immigrated from Mexico. He is also a member of the San Diego La Raza Lawyers Association, which works with Latino law students and lawyers. Trump’s trial for the Trump University case is scheduled to be heard in November, after the election.
